Certainly, since 2020, the EU institutions have been warning that the digital transformation must necessarily be accompanied, in order to avoid discriminatory effects, by rules that meet the needs of the elderly, since these, not being familiar with digital tools, are prone to be affected by situations of financial exclusion and even fraud.
Despite the community framework, full of good intentions, the only regulatory reference that we find in Spanish law is Law 4/2022, on measures to protect consumers in situations of economic and social vulnerability, which are limited to a commitment by the government to establish, in coordination with the Bank of Spain and financial institutions, Certain inclusive measures, including the creation of simpler and more understandable technologies, increased safety and face-to-face care for the elderly in the use of digital technologies
Unfortunately, all this has been left in the mud and has not materialized in any concrete protective measure for the elderly bank customer.
