JUDGEMENT WON IN BANK PHISHING
Alicante Provincial Court has confirmed the sentence of Orihuela Court which doomed Banco Santander to pay the 4.985.-€ that were stolen to its client due to a bank phishing.
On October, 13th, 2022, sentence 298/2022 issued by Orihuela Court Nº 3, which upheld the claim for compensation for damages filed by Palomar Abogados in favor of a woman affected by bank phishing, was appeal by CAJA RURAL CENTRAL by assessing that its client had not taken a responsible behavior concerning de privacy of his personal passwords.
CAJA RURAL CENTRAL appeal was rejected by Alicante Provincial Court through Sentence 93/2024, of February 16th, which confirmed Orihuela Sentence by dooming the bank to compensate 4.985.-€ to its client; such sentence assessed that in effect there had been a breach affecting bank security system, and thus responsibility for it had to be charged exclusively to CAJA RURAL CENTRAL.
