JUDGMENT WON IN BANK PHISHING
A court sentences Banco Santander to pay our client 6.000 € that were stolen by a bank phishing
The Prat de Llobregat Court No. 3 has issued judgment 22/2024, by virtue of which it upholds the claim for compensation for damages filed by the law firm Palomar Abogados in defense of a bank customer who had been the victim of a phishing in his bank; the court decision obtained by Palomar Abogados declares the civil liability of BANCO SANTANDER considering that the aforementioned financial institution is responsible for a security breach in its payment service, and has ordered it to compensate our client for the full amount of the 6,000 euros that were stolen from his bank account, and also to pay both the legal interest accrued and the costs of the legal proceedings.

The amount of €6,000 had been illegitimately stolen from the bank account that the victim had opened at BANCO SANTANDER through deception or phishing. This deception was implemented through an SMS sent by the cybercriminal, in which he pretended to be solving a security incident, and showed him a link that redirected him to a web domain that appeared to be a BANCO SANTANDER website, and in which he had to provide his security credentials and credit card number; The affected party, in good faith, provided the required information, and as a result two unauthorized payment orders were made for €2,400 and €3,600 respectively.
